Somerville Urban Forestry Committee Plans Foss Park Pollinator Garden, Warns of Ordinance Legal Risk

Somerville's Urban Forestry Committee flagged potential legal vulnerability in the city's tree preservation ordinance while planning a weekend pollinator garden installation at Foss Park. Co-Chair Michael Hendricks drew members' attention to a Planet Money episode describing successful property-rights litigation against a Michigan tree ordinance under the takings clause of the Constitution, noting that Massachusetts law protects street trees and neighbors' trees but does not bar owners from removing trees on their own property outside of local rules. "We're a little vulnerable if someone wanted to come after us," one member said.

The committee discussed expanding a native tree guide produced with the Mystic River Watershed Association for distribution at tabling events including ArtBeat on July 18. Senior Urban Forestry and Landscape Planner Vanessa Bukili reported 177 city trees planted this spring — above the typical 175-tree target — and disclosed that an equity staff position within the Office of Strategic Planning and Community Development has been eliminated as the office is rebranded Strategy and Development on July 1. The tree crew remains at two members, with a third position being reclassified from tree surgeon to laborer to attract more applicants.

The committee unanimously approved minutes from April and May and is carrying its formal recommendations for Mayor Jake Wilson to the July meeting.
